1. ACCEPTANCE OF TERMS

By purchasing a product, activating a device, subscribing to a service, or logging into any platform operated by BrickHouse Electronics LLC, including any and all brands, and trade names including BrickHouse Security or BrickHouse GPS (collectively, "BrickHouse", or "we", or "our"), you agree to be bound by these Terms of Service ("Terms"), and our Privacy Policy. If you do not agree to these terms, do not complete your purchase, activate a device, or log in to our services.

As used in these Terms, "you" and "your" refer to the individual or entity purchasing, activating, subscribing to, or using BrickHouse products or services.

YOUR ACCEPTANCE OF THESE TERMS MAY BE EXPRESSED BY:

  1. CLICKING TO ACCEPT OR AGREE WHERE THIS OPTION IS MADE AVAILABLE TO YOU;
  2. COMPLETING A PURCHASE;
  3. USING BRICKHOUSE SERVICES; OR
  4. SIGNING A PHYSICAL DOCUMENT REFERENCING THESE TERMS.

SUCH ACTIONS CONSTITUTES A LEGALLY BINDING ACCEPTANCE OF THESE TERMS.

2. SUBSCRIPTIONS & AUTO-RENEWAL POLICY

2.1 Subscription Requirements

  1. All GPS tracking services require a subscription, which automatically renews at the end of each billing period unless canceled before the next renewal date.
  2. BrickHouse ships all items pre-activated with a service subscription that begins billing 7 days after your shipping date.
  3. For activation requests submitted on the BrickHouse website or via phone, billing will begin immediately.

2.2 Payment and Billing

  1. The payment method on file will be charged automatically at the renewal date. For clarity, in the event a bank or credit card company automatically updates your payment method information (e.g. card number and expiration date), you expressly authorize BrickHouse to charge such updated payment method.
  2. Subscription renewals are non-refundable after 7 days, unless otherwise required by law.
  3. You will be automatically charged for all services to the credit card provided during activation.
  4. By providing your credit card information, you authorize BrickHouse to charge it for all services and amounts due.
  5. BrickHouse reserves the right to charge any credit card listed on your account if the default card declines.
  6. If we are unable to successfully charge you for service fees, BrickHouse may terminate your service without notice.
  7. A credit card on file is required for all accounts with active service subscriptions unless otherwise stated in your customer payment terms.

2.3 Plan Selection

  1. The default plan for BrickHouse GPS products is stated on the product page for the applicable device.
  2. Other payment tiers & options are selectable after checkout, or by contacting the BrickHouse customer support team.
  3. If no plan is selected after checkout, you will be enrolled in the default plan stated on the product page for your device.

2.4 Quarterly and Annual Plans

  1. By enrolling in a quarterly or annual subscription plan, you agree to pay for the full term of service at the time of your first billing.
  2. The advertised monthly effective rate of BrickHouse's prepaid plans is only applicable when paying for the entire service term in full.

2.5 GPS Insurance Plan

  1. Insurance covers cellular network changes, lost, broken, or stolen devices.
  2. Insurance is billed in addition to your device's subscription.
  3. You must have an active device & insurance subscription to redeem a replacement device.

2.6 Cancellation Policy

  1. You may cancel at any time via BrickHouse's Cancellation Portal or by contacting customer support.
  2. To avoid renewal charges, cancellations must be submitted before the next billing date.
  3. If you cancel within 7 days of renewal and have not used the service, you may be eligible for a full refund.
  4. Customers who cancel before the end of a billing period will retain access to the service until the end of the current billing cycle.
  5. By purchasing or activating service, you accept full responsibility for notifying BrickHouse of any issues or changes to your service.
  6. You will continue to be billed regardless of whether the device is being used, as BrickHouse incurs costs for keeping your account active.

2.7 SMS/Mobile Communications

  1. You agree to receive customer care and account notification messages from BrickHouse.
  2. Message frequency varies. Message and data rates may apply.
  3. For help, call or text BrickHouse at (800) 654-7966 for support.
  4. You can opt out at any time by replying STOP.

3. TRIAL OFFERS

3.1 Participating in a Trial

By participating in a trial offer provided by BrickHouse, you acknowledge and agree that:

  1. Trial plans may be for different service levels.
  2. Customers on a Basic plan may receive a free trial of the Plus plan, or another upgraded service tier.
  3. Your explicit consent is obtained when enrolling you in a trial upgrade, either through opt-in during checkout or through confirmation of the trial offer via email or SMS.
  4. At the end of the trial period, your subscription will automatically revert to the original plan unless you choose to upgrade to the trial plan's paid version before the trial ends.
  5. If you were not previously subscribed, the trial will convert to a paid subscription at the standard rate unless you cancel before the trial expires.
  6. You can cancel at any time before the trial expiration date to avoid charges.
  7. The payment method on file will be charged upon trial expiration unless canceled.

3.2 Cancelling a Trial

You may cancel your trial at any time by contacting the BrickHouse customer support team before the trial period expires. Once a trial is converted to a paid subscription, standard cancellation and refund policies apply.

4. PAYMENT PROCESSING

4.1 Credit Card Orders

  1. BrickHouse reserves the right to request additional information for proof of billing information.
  2. Credit card orders may be delayed while BrickHouse confirms your billing information.
  3. Please provide your exact billing address and telephone number which must be the address and phone number your credit card company has on file for you.
  4. Incorrect information may cause a delay in processing your order.

4.2 Payment Processing Information

  1. Once BrickHouse receives credit card authorization, the funds may be reserved up to 30 days depending on your bank.
  2. If you are paying with a Debit Card, be aware of any limitations on daily withdrawals of your card.

4.3 Alternative Payment Methods

  1. Cashier's checks, bank checks, company checks, money orders, and international wire transfers are acceptable forms of payment.
  2. For bank and company checks, orders will ship only after funds are released from your financial institution to BrickHouse (10-15 business days after receipt of payment).
  3. All checks returned unpaid will be subject to a $40.00 returned check fee plus interest at 10% per year, or the highest rate permissible by law, whichever is lower.
  4. Wire transfer transactions may be subject to a processing fee.

5. PRICING AND AVAILABILITY

  1. Due to changing cost and availability, BrickHouse reserves the right to change prices without notice.
  2. BrickHouse does not assume responsibility for any errors contained in pricing information.
  3. BrickHouse reserves the right to cancel any orders received without notice.
  4. BrickHouse does not offer price protection. If the price is lowered on the BrickHouse website after your order, BrickHouse is not obligated to refund the difference.
  5. Receipt of an e-mail order confirmation does not constitute acceptance of an order.
  6. BrickHouse reserves the right to correct pricing errors, limit order quantity, and refuse service to any customer.

6. SALES TAX

  1. BrickHouse collects sales tax in accordance with applicable state laws.
  2. If BrickHouse collects sales tax on your order, it is because your state requires BrickHouse to do so.
  3. All taxes collected are remitted to the appropriate state government.
  4. BrickHouse cannot waive sales tax unless you provide an official tax-exempt certificate showing your status as a non-profit, government agency, or reseller.

7. RETURNS AND REFUNDS

7.1 30 Day Money Back Guarantee

  1. Returns & refunds are only available within 30 days of purchase.
  2. Any requests for refunds made after 30 days may be denied.
  3. Any services purchased from BrickHouse shall be subject to the refund provisions of this Section.
  4. For clarity, any hardware purchased from a 3rd party Marketplace must be returned to the Marketplace, in accordance with the Marketplace's policies in effect at the time of purchase. Items must be returned in original condition with all accessories and packaging.

7.2 Limitations

Some items must be returned in original unopened packaging to be eligible for a refund:

  1. Custom made or special order items;
  2. Potentially contaminated items that present hygiene concerns once used;
  3. Pepper Sprays;
  4. Boxed software (downloadable software is non-returnable).

7.3 Refund Processing

  1. All refunds will be issued back to the original form of payment used for the purchase. If the original payment method is no longer valid (such as a closed credit card), it is the customer's responsibility to notify BrickHouse prior to any refund being processed. In such cases, BrickHouse will issue a check and mail it to the billing address provided for the account. BrickHouse will not issue refunds to alternative credit cards. If a refund is issued to a closed account and BrickHouse was not notified of the account status prior to processing the refund, BrickHouse will not be able to reissue the refund via check unless the funds are returned to BrickHouse by the customer's bank.
  2. Refunds will be issued for the item(s) returned only.
  3. Shipping charges from the original order will not be refunded.
  4. Refunds for subscriptions are only available under the 7-day refund grace period if the service has not been used.

7.4 Exchanges

  1. If you prefer to exchange your item for a different product, contact BrickHouse within 30 days of receiving your item.
  2. Any price difference for the exchange will be charged or refunded as appropriate when your return is processed.

7.5 Return Shipping

  1. Return shipping is paid for by the customer for all products, unless the item is defective and under warranty.
  2. For qualifying returns, a prepaid return label will be provided.
  3. BrickHouse recommends using a traceable return mailing service and keeping a record of the tracking number.
  4. BrickHouse is not responsible for lost return shipments.

7.6 Inspection Process

  1. All items returned are subject to an inspection/testing process.
  2. If an item is not in resalable condition, you may be charged a restocking fee for damages or missing parts.
  3. If a product has been altered or physically damaged due to misuse, this may void the warranty and/or return eligibility.

7.7 Unauthorized Returns

  1. Items returned without a return merchandise authorization may be denied and sent back to the customer.
  2. All returns must be requested by calling BrickHouse's toll-free number for proper authorization and instructions.

7.8 International Returns

  1. BrickHouse cannot reimburse any customs or duties fees paid by international customers in the event of a return.
  2. If a package is returned due to refusal to pay customs fees, any fees charged to BrickHouse by the carrier will be deducted from your refund.
  3. If refusal to pay customs fees results in the package being abandoned and not returned to BrickHouse, BrickHouse cannot issue a refund.

8. ORDER CANCELLATIONS

  1. In most cases, once an order is placed, BrickHouse cannot cancel it due to BrickHouse's rapid processing and shipping.
  2. If you no longer want a product after ordering, contact BrickHouse for a Return Merchandise Authorization number.
  3. If your product has shipped and you refuse delivery, you will be responsible for shipping costs in both directions and possible restocking fees.

9. SHIPPING POLICIES

9.1 Shipping to Non-Billing Addresses

  1. To protect customers from credit card fraud, orders being shipped to an address different from the billing address may be held for verification.
  2. If BrickHouse cannot verify the shipping address, BrickHouse may require shipment to the billing address or to a FedEx Shipping Center for pickup.

9.2 Signature Requirements

  1. Most orders do not require signature on delivery.
  2. Depending on the dollar amount, orders may be shipped "Signature Required" for proof of delivery.
  3. If you cannot be present to sign, contact the shipping carrier directly to arrange package holding at a local facility.
  4. Packages returned to BrickHouse due to delivery issues will be subject to restocking fees and return shipping charges.
  5. Customers assume responsibility for damaged merchandise signed for at delivery.

9.3 International Shipments

  1. BrickHouse is not responsible for any additional charges levied by the recipient's country for importing our products.
  2. For warranty replacements sent internationally, we will mark packages as replacement products, but recipient countries may still impose customs or duties fees.
  3. Any customs or duties fees remain the responsibility of the customer.

10. REPLACEMENT AND REPAIRS

10.1 Standard Replacement

  1. All products are backed by our standard 90 Day Replacement Guarantee.
  2. If your product stops working within 90 days of receipt and troubleshooting cannot resolve the issue, we will issue a replacement of the same item.

10.2 Lifetime Service Replacement

  1. Any GPS product with a recurring subscription service is automatically covered by our Lifetime Service Warranty.
  2. As long as you maintain active service for the device with BrickHouse, we will replace or repair any malfunctioning item.

10.3 Manufacturer Warranty

  1. Select products carry a separate manufacturer warranty of 12 months from the date of purchase that may be redeemed directly from the manufacturer.
  2. This warranty covers defects in materials and workmanship under normal use.
  3. To claim warranty service, proof of purchase, all original packaging, accessories, and documentation must be provided.
  4. The warranty does not cover damage resulting from accidents, misuse, abuse, improper installation, or unauthorized modifications.
  5. THE WARRANTY DOES NOT COVER DAMAGE RESULTING FROM ACCIDENTS, MISUSE, ABUSE, IMPROPER INSTALLATION, OR UNAUTHORIZED MODIFICATIONS. BRICKHOUSE SPECIFICALLY DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.4 Warranty Claim Process

  1. All warranty claims require troubleshooting with the BrickHouse customer support team before a replacement can be issued.
  2. As part of BrickHouse's inspection process for warranty replacement requests, all items are tested upon receipt.
  3. If the returned item is found to be in working condition and free of defects, your original item will be returned to you.
  4. If the item is confirmed to be defective, a new replacement unit will be shipped.
  5. In select cases BrickHouse may agree to ship your replacement in advance of you returning your defective item. If you fail to send back your return within 21 days you will be charged in full for your replacement order.

11. CHARGEBACKS

11.1 Unauthorized Chargebacks & Fees

  1. By purchasing from BrickHouse, you agree to resolve any billing disputes directly with BrickHouse first before initiating a chargeback.
  2. Unauthorized chargebacks (filed without prior notice to BrickHouse) may result in:
    1. Account suspension or termination across all services;
    2. A chargeback fee of $50 to cover administrative costs and bank fees; and/or
    3. Reversal of any promotions, discounts, or trial offers applied to the disputed transaction.
  3. If a chargeback is invalid (e.g., the transaction was authorized and services were used), the chargeback fee and outstanding balance must be paid before your account can be reinstated.

11.2 Resolving Billing Issues Without Chargeback

  1. Contact BrickHouse via our Support Portal or call 800-654-7966 before filing a dispute.
  2. If a refund is due, BrickHouse will process it directly to avoid unnecessary fees and account restrictions.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BRICKHOUSE ELECTRONICS LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, BRICKHOUSE SERVICES.

UNDER NO CIRCUMSTANCES WILL BRICKHOUSE'S TOTAL LIABILITY OF ALL KINDS ARISING OUT OF OR RELATED TO THESE TERMS (INCLUDING BUT NOT LIMITED TO WARRANTY CLAIMS), REGARDLESS OF THE FORUM AND REGARDLESS OF WHETHER ANY ACTION OR CLAIM IS BASED ON CONTRACT, TORT, OR OTHERWISE, EXCEED THE TOTAL AMOUNT PAID BY YOU TO BRICKHOUSE DURING THE 12 MONTHS PRIOR TO THE CLAIM ARISING.

13. COMPLIANCE WITH COURT ORDERS AND SUBPOENAS

  1. BrickHouse complies with all applicable laws and will cooperate with law enforcement agencies, regulatory bodies, and courts when legally required.
  2. We will respond to valid court orders, subpoenas, or legal requests as required by law.
  3. Data will only be provided if the request is legally valid and complies with applicable privacy laws.
  4. BrickHouse reserves the right to challenge or refuse unlawful requests that do not meet legal standards.
  5. Customers will not be notified of such disclosures if legally prohibited from doing so.
  6. Legal requests must be submitted via official legal channels.
  7. All legal documentation must be properly signed and include the requesting authority's contact details.

14. DISPUTE RESOLUTION: ARBITRATION AND MEDIATION AGREEMENT

14.1 Mandatory Arbitration & Mediation for Disputes

By using the services of BrickHouse Security or BrickHouse GPS, you agree that:

14.1.1 Binding Arbitration

ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS, PRODUCT PURCHASES, SERVICE SUBSCRIPTIONS, OR USE OF BRICKHOUSE'S PLATFORMS WILL BE RESOLVED EXCLUSIVELY THROUGH BINDING ARBITRATION, RATHER THAN IN COURT, EXCEPT AS OUTLINED BELOW.

  1. The arbitration shall be conducted under the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration body.
  2. Each party is responsible for its own arbitration fees, except where prohibited by law.

14.1.2 Pre-Arbitration Mediation Requirement

  1. Before arbitration, both parties must first attempt mediation to resolve disputes informally.
  2. Mediation will be conducted via telephone, video conference, or in-person (if applicable) using a neutral third-party mediator.

14.1.3 Exceptions to Arbitration

  1. Small Claims Court: You may file an individual claim in small claims court if the claim qualifies.
  2. Legal Compliance Requests: BrickHouse reserves the right to seek injunctive relief or enforcement of court orders without arbitration.

14.1.4 Class Action Waiver

YOU WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST BRICKHOUSE ELECTRONICS LLC. ALL DISPUTES MUST BE FILED INDIVIDUALLY, NOT AS PART OF A GROUP.

15. GOVERNING LAW

These Terms of Service are governed by the laws of New York. Any legal disputes must be resolved through arbitration before pursuing legal action.

16. INTELLECTUAL PROPERTY

  1. All content included on the BrickHouse website and in BrickHouse services, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of BrickHouse Electronics LLC or its content suppliers and protected by United States and international copyright laws.
  2. The compilation of all content on the BrickHouse website is the exclusive property of BrickHouse Electronics LLC and protected by U.S. and international copyright laws. All software used on the BrickHouse website is the property of BrickHouse Electronics LLC or its software suppliers and protected by United States and international copyright laws.

17. GENERAL

17.1 Electronic Communications

By using BrickHouse services or providing personal information to BrickHouse, you agree that BrickHouse may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the services. You agree that BrickHouse may provide notices to you by posting them on the BrickHouse website, emailing them to an email address that you have provided, or communicating through a mobile application or other similar means.

17.2 Force Majeure

BrickHouse shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond BrickHouse's reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation, acts of God, terrorist acts, public health emergencies, pandemics, government restrictions, riots, strikes, and labor disputes.

17.3 Severability

If any provision of these Terms is found to be unenforceable or invalid, such provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

17.4 Assignment

BrickHouse may assign or transfer these Terms, in whole or in part, without restriction or notification to you, to any person or entity who acquires all or substantially all of BrickHouse's assets, stock, or business by merger, acquisition, consolidation, or otherwise. You may not assign or transfer these Terms, your account, or your rights and obligations hereunder, in whole or in part, to any third party without the prior written consent of BrickHouse, and any attempted assignment or transfer without such consent shall be null and void.

17.5 No Waiver

The failure of BrickHouse to exercise or enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

17.6 Entire Agreement

These Terms, together with BrickHouse's Privacy Policy, constitute the entire agreement between you and BrickHouse regarding your use of BrickHouse services.

17.7 Modifications

Any modifications to these Terms will be effective upon posting to BrickHouse's website or notification to you.
